Attainment Terms & Conditions
All long standing terms, conditions, dates and practices are clearly outlined below and are fair & standard policy to better serve our clients and release any liability of Attainment/Lou DePasquale. Each client or party retained/working with Attainment/Mr. Lou DePasquale, fully consent to the below and will be fully bound by the following before, during and after coaching and consulting with no exceptions. We of course, do not anticipate any problems with clients or services, however it is crucial to openly disclose all aspects of rules and regulations.
Like anything else, due diligence on clients part is key beforehand. There are no exceptions to break these rules and policies at any time, and Attainment/Mr. Lou DePasquale hold no responsibility and/or liability for client/party's failure to read, because policies are clearly stated on this page. This public page is posted for all to see before, during and after coaching and consulting, so there are no miscommunications or unreasonable expectations at any point in time. * Life Management, Coaching, and Consulting as outlined, is to assist clients with insight, accountability and advising purely from the experience & knowledge of Mr. Lou DePasquale. Mr. DePasquale is not a doctor, therapist, counselor, psychiatrist or psychologist of any kind respectively, nor claims to be.
If you have any questions or you are uncertain if Attainment can help, please simply contact us beforehand. We retain our clients on a case by case basis and review each person/situation before coaching. Attainment and Mr. DePasquale also have the right to refuse service and coaching to any party we deem not fit for any reason. If we cannot help, we will kindly suggest someone who might be a better fit. Attainment/Mr. DePasquale will not be held liable for any unreasonable expectations or mis-communications with clients or potenial clients at clients mental or physical fault. This includes but is not limited to, any information that a client or potential client fails to disclose to us before sessions, as we can only go by what we are told by client in terms of past and current life, career and/or business history. Please also note that all interactions/agreements/invoices/services and more with every single client are hereby categorized acceptable, as/and/or/including, verbal and written communication via email, postal mail, telephone and in person, no matter client state or country. Client understands that an agreed invoice and/or credit card statement for package or service of any kind, constitutes a full binding obligation and is same as a contractual agreement, which must be seen through until the end date following all below guidelines and rules. Please, no excuses and no exceptions.
* Each Package listed is per person/client/spouse etc. and reflected on separate invoices. Packages are all sold seperately and cannot be shared by any two people at any time. No Exceptions. IMPORTANT NOTE: If any person (Client's spouse, family member, friend etc..) that is not prepaid or has a package, they will be charged $99 per 45 minutes (and billed properly for time after the 45 minute mark) when they talk with Mr. DePasquale by cell phone or landline, 24/7. No exceptions, as we must be fully compensated for time spent on the phone or in person with any respective party/person that is does not have a prepaid commitment with Attainment. Please do not ask us to bend or break this rule, as it is long standing and only fair if one does not have a package or prepaid time with us. An invoice or detailed email will follow the charge for each person in this situation. "Trial Offers" of any kind are not something we do, however if a client would like to do a single session (in person/Utah or phone) it will be $99 per 45 minutes as a standard and are only offered one time per each new client. After the one time single session, client must then choose a package of their liking.
* Attainment Package & Inspiration Packages can be payed by credit card or personal/business check at our choice and full discretion. Attainment Package & Inspiration Packages are based on the basic format of one 45 min. session per week for Phone Attainment Package and up tp 60 min. per weekly sessions (max) with in person Attainment Package and Unlimited Email Support for each month (3). 24/7 direct support is time counted and must be observed in "respected moderation" by client. NOTE: ANY "Attainment Package Promo" or "Inspiration Promo" (Winter Package and so on) is based on 1 scheduled 45 min session per week (weekly and otherwise defined at "standard session time"). Respected Moderation is defined as client understanding that we are here to support, but it must be within reason, as we do have personal time outside of work and will return calls and texts as time allows. A good rule of thumb is to call us with a "15 min call here and a 10 min call there" in terms of every few days between 24/7 calls. We reserve the full right to limit a client on their 24/7 direct phone support to Lou DePasquale if we feel it is being abused in any way. We clearly outline all 24/7 direct support guidelines to each client before they start their package. Furthermore, each package is for 3 months of use or 6 months of use, so any time that is lapsed due to clients behalf within paid 3 month or 6 month, is at responsibility and loss of client. This includes but is not limited to client vacations, other scheduling, busy time, work or any other reason that client states that time has lapsed between weekly sessions. We do not pro-rate, and any time unused within 3 month period is not the fault of Attainment, but that of the client. So please use time wisely and consistently to receive the full benefits of this package.
*Expiration of a session package - Example: If a client has a session package from "November 15th - February 15th" the official expiration of the package is 12am ON February 15th. Which means client would have to have a new package in place starting on February 15th to continue through that same day. Just as commencement of the package would be 12am on November 15th, in this particular example.
*Aside from actual session(s), time invested (such as research, other time together/needed etc.) will be billed to client on the scale of $75 per each 45 minutes as invested by Attainment. Our Attainment Package is exempt from this rule, and other packages will be charged through time pre-paid for.
* Promotional Packages (Including Perseverance Package & KUTV Fresh Living "Buy 1 Phone Session Get 1 Free") & Services listed as *Promo* throughout website or as advertised outside of our site, are limited to one time, per new client only and performed via telephone only. In person is not an option for these promotions. Furthermore, one client per credit card and one client per household. Like all services and packages, promotional services are non-refundable once purchased, and will not be pro-rated for sessions/time that might go un-used by client.
* Please understand that "Our Process" together will take time, consistency and 100% effort on your end. We highly encourage our clients to take advantage of our sessions on a weekly or bi-weekly basis at the latest. This practice ensures consistency and follow through in a much needed, timely manner without lapse. Leading to better results. Attainment will do everything possible to be timely and proactive on a weekly basis with client and session scheduling. However, each client is fully responsible with use of their packages and session time. We will not be held responsible for any client that fails to comply with session and package rules once a package is purchased. So please be proactive and diligent with your session packages, time and reaching out to us. Otherwise, you will be paying for a service that you are not using, when you should be using it every week.
* Attainment reserves the full right to perform any session or entire session package by telephone as needed or if we choose. Sessions in the State of Utah are perfomed by telephone or in person at sole discretion of Attainment and our respective schedule and meeting place (Usually downtown SLC at the main library). We have the right to cancel an in person session and move it to telephone session. "In Person" sessions are clearly defined as: "Sessions performed at agreed meeting location in Utah, at the agreed time/day of both client and Attainment." Furthermore, please see next section for transportation costs with multiple visits. Clients outside of Utah are telephone sessions only. Standard policy for ALL, is for client to "call into" Attainment's offices for each agreed session from their respective phone. This fully includes USA and International clients. We will instruct you via email, text or phone, beforehand of course, to call our landline - (801) 412-2607 for each actual session. 24/7 pre-scheduled sessions must simply be agreed upon by both parties beforehand, due to each parties respective schedules. We will also discuss beforehand, if any client in Utah is to be performed by telephone sessions only to better accommodate locations of client and Attainment. "Gold Package" cannot be used for in person sessions, but via telephone only. If you would like a mix of in person (Utah) and phone sessions, please purchase our Elevation Package, Attainment Package (Original) or Inspiration Package.
* If client does prefer Attainment to do multiple weekly sessions in person (Utah), we will require fair compensation for travel with the exception of The Attainment Package. All other packages will accrue an additional charge to and from agreed location. This is purely case by case and we will discuss this with you in consultation. Options range from agreed upon addition to package, or limited discount to fairly compensate. Please understand that with very high fuel costs in 2011, it is tough for any company to balance multiple visits without passing on even the slightest of burden to the customer.
*Upon expiration of a package or service of any kind, Attainment reserves the right to not renew client (s) for any reason. We will of course kindly notify client via email ( client address on file) and telephone of this in fair timeframe of 14 Calendar DAYS before expiration. We are happy to offer optional packages, and hopefully further business with each client, but sometimes this is not the case and the best scenario is to cease further services.
*All clients will be charged 6.850% Utah States Tax. This includes all regular and discounted sessions and and/or packages. So naturally your grand total on each invoice will differ once sales tax is calculated and added to your bill. Attainment keeps proof of all invoice records, client emails and credit charged dates to illustrate agreed terms for each package and service. Please do not contact us with excuses that an invoice was not received after agreed date/time. It is due diligence on clients end to make sure they receive documents, once we have stated and retain concrete proof that they were in fact sent on our end to provided client email.
*Attainment reserves the right to charge clients credit card for all applicable services/time used by client, that are not covered by a certain package or noted as pre paid. This practice is similiar to a "Taxi Cab Meter." You are immediately charged for the services/time that you use. We will of course notify you of this, as/if needed. We also reserve the right to charge client credit card (already agreed services via client invoice) up to 5 Full Days of actual invoice/agreed charge date. We do this (especially for block payments), to ensure full processing and clearance of funds as to not disrupt any service of your package and to be sure funds are readily available for services due on client behalf. If you (or party) are on "Auto-Renewal" (agreed automatic card charge every month or every other month, and/or agreed spousal package renewed upon each expiration etc.) you must submit in writing (confirmed email) that you wish to cancel your service or package, at least 14 days before actual date of charge. No exceptions to the 14 days in writing. Once we have received your email, you must receive a confirmed response from us that cancellation has been successfully processed on our end, please do not blindly send an email and hope for the best. Please make sure you get the confirmation. As always, once we charge your credit card, everything is 100% non-refundable and you will have to wait until your next package expiration under the same timelines above, to properly cancel and service or package from Attainment.
* We know your time is valuable and schedules do change. However, this must be respected for us as well and our time is limited for other clients in a given day. Attainment requires that if a client does not give us at least 12 hours notice to cancel or change any pre-booked session, then that session will be lost and client will be charged as normal. This is equal to all, and no exceptions will be made. Scheduled Appointments & Sessions that result in "No Show or No Call" on clients behalf, will result in a full loss of that session as well. We do our very best to stay diligent, however we will not be held liable for mistakes in specific client session times, lengths or dates of any kind other than what we note before and after each session. We do not/will not disclose copies of session time or date logs for any client. All "session time" is "clocked" by us and is the final applied session time for each and every client. No Exceptions. We do not accept client phone records or any other time "record" from client of different time, other than what we have written down for each session from our official session clock. Any "in person" session that results in a "No Show/No Call" on behalf of client, will be charged the full session, plus travel time to and from agreed meeting location. Our long time company standard is to "wait" at least 15 minutes into each session for client to call or show. If 15 minutes passes, we will no longer wait and the actual session will then be deemed a "no show." Many times we will set a "weekly date & time" with a client and this date is to stay consistent and true unless client or Attainment gives notice for a different date/time for the actual session that week. For example: If client & Attainment agree to talk "Every Wednesday at 1pm MST" then Attainment will be ready for session at that time. If client forgets, (does not want to talk that week, time conflict, or for any other reason that causes them to not call) at the agreed date or fails to call/show, then the missed session is at the full loss of the client, since no advance was given to change the date/time. Even though we might sometimes send an email reminder to a client at random times for an upcoming pre agreed session, we are in no way obligated to do so once we initially agree on a weekly time/date for each upcoming week. If missing sessions starts to be a continual problem for the client, this falls under the above category as "client responsibility for any missed time" and Attainment will not be held responsible in any way. Also, as indicated on this page, all sales are final and no package will be pro-rated or cancelled for client lack of interest. So we encourage you to be proactive with us.
* Once purchased (clearly defined as "agreed upon package and client credit card is then charged") or re-newed with Attainment, All Packages, Specially Discounted Items, E-Coaching Program, All Promotions, Attainment Package, Career Coaching Program, Sessions, Single Sessions & Services are 100% Non-Refundable (NRF). This is all standard policy and there are No Exceptions for refunds or chargebacks of any kind for any newly purchased or re-newed service once transaction is fully agreed to by Attainment and client (including clients parents, cardholder or client representatives if applicable) via phone, email or in-person and credit card is THEN charged (normally the same day/evening), the order, any sessions, all packages is then 100% considered completed and non-refundable. Regardless of actual start time (prepaid or regular) of package or sessions/service, and or issuance of invoice/credit card statement.
No exceptions on these rules as they apply to all personal, career and business coaching clients, spouses whom have separate packages, all services/packages. This policy also includes " 24 hour and or change of heart," lack of use or any other reasons, as each client has ample time beforehand, to decide what service or package to actually commit to and purchase. ALL packages and agreed services include verbal and/or written email correspondence. Please note that we keep all emails received and sent from clients, to better protect ourselves and use emails, credit card charges and/or invoices as complete contracts between client and Attainment. An Attainment invoice and/or credit card statement charge, are legal documents which are used as evidence of an fully agreed to and incurred debt by client for ANY service or package with Attainment and fully illustrate that a client agreed to all charges and services beforehand. Any client/party retained by Attainment for any service or package, fully understands, consents and agrees that any agreed invoice and or credit card charge, ( including anything verbally and written), fully serves as a contractual agreement and lawful obligation between Attainment and client/party, and all terms and conditions will be fully met without problem on client end. No refunds, cancellations, attempted chargebacks or disputes of any kind are accepted by Attainment or our credit card and/or bank merchant, via client purchase for any fully agreed/invoiced service and/or package, once finalized. We do reserve the right to charge any client credit card in "block" payments, simply due to client credit limits and timeframe. Nevertheless, all charges will always reflect the exact same amount as client is invoiced, and never a penny more.
Again, once a client agrees/purchases ANY service or package, and we charge the credit card or cash your check, it is at that point 100% non-refundable, no exceptions. Thank you for your understanding as this is standard policy for all.
Due to tight scheduling, booking times, time vested and/or pre-discounted pricing at time of purchase and many other factors, these rules are clearly stated. We also do not and will never pro-rate days, packages or pre-paid session time, and any sessions/time/packages that are willfully un-used by a client at any point in time or for whatever reason, will not be refunded and must be used.
